Syrian troops holding fire after dawn deadline
BEIRUT (Reuters) - Syrian troops held their fire in the hours after a U.N.-backed ceasefire took effect at dawn on Thursday, casting a silence over rebellious towns they had bombarded heavily in recent days.
But the lull did little to convince opposition activists and Western powers of President Bashar al-Assad's good faith in observing a peace plan agreed with international envoy Kofi Annan. In defiance of that deal, Syrian troops and tanks were still in position inside many towns, activists told Reuters.
"It was a bloody night. There was heavy shelling on the city of Homs. But now it is calm, and there is no shooting," said Abu Rami, an activist in Syria's third city after the 6 a.m. (11:00 p.m. Eastern Time) deadline passed. Assaults on restive neighborhoods had become more intense after Assad accepted Annan's timetable.
At the United Nations, Annan will brief the deeply divided Security Council at 10:00 a.m. Eastern Time. Western powers, though hesitant to intervene militarily, are lobbying Russia, a key ally for Assad, to drop its veto on other U.N. measures to pressure Syria into abandoning four decades of autocratic rule by the his family.
The 13-month crisis has pushed out pressure waves along a web of faultlines across the Middle East, pitting Sunni Arabs against Shi'ite Iran, and alarming Turkey, whose prime minister on Thursday cited his country's right to call on its NATO allies to defend a border where Syrian troops opened fire this week.
People contacted by telephone in the flashpoint provinces of Homs, Hama and Idlib, which have been under sustained shelling by Assad's forces over the past week, reported calm. An activist in Damascus said the capital was also quiet.
"More than two hours have passed, and it's completely quiet across the country," said Rami Abdulrahman, director of the British-based Syrian Observatory for Human Rights (SOHR).
The Syrian government bars access to most independent media.
Like activists in other cities, the man who uses the cover name Abu Rami said there was no indication troops were withdrawing from Homs in accordance with the agreement.
"There are no signs of a pull-back; the tanks, snipers and armed forces are still visible across the city," he said.
DIPLOMATIC BATTLE
British Prime Minister David Cameron, speaking after the lull was reported, said Assad was failing to abide by the terms endorsed by the U.N. Security Council last week: "I feel an immense sense of frustration because the world has come together behind this Kofi Annan plan," he told the BBC.
"This is a plan, remember, that is not just backed by those of us who have been pushing for action on Syria, it's also backed by China and Russia. And yet Assad is deliberately flouting it."
In an indication of how the Western leaders who intervened to help rebels topple Muammar Gaddafi in Libya last year are reluctant to do likewise in Syria, Cameron made it clear that the main thrust of Western efforts would be to persuade Moscow and Beijing to accept tighter punitive sanctions.
"Now is the time to say to the Russians and Chinese, look at the man we are dealing with, look at the appalling way he is behaving," Cameron said. "We need to go back to the U.N. and tighten the pressure, tighten the noose."
The opposition Syrian National Council is also lobbying for a strong international ultimatum to Assad if the peace fails.
Russia and China, alarmed by the way last year's Security Council resolution on Libya led to military intervention against a sovereign state, have vetoed attempts to penalize Assad, although the United States, European Union and Arab League have imposed their own economic and political sanctions.
China's Foreign Ministry called on the opposition to honor the truce, something the disparate rebel movements have said they are willing to do - although Western leaders and Annan's team have made clear the onus is firstly on the government.
"China welcomes the government's relevant decision, which will help to ease tensions," the ministry said in a statement. "China also calls on the Syrian armed opposition to immediately cease fire and implement Annan's six-point proposal."
TROOPS STILL IN CITIES
Annan has said he has Syrian assurances that the ceasefire would be respected, though his spokesman was at pains on Wednesday to stress that other elements of his plan must also be respected - notably "Item 2", which calls for armed forces to withdraw from the vicinity of urban areas.
Syria's Defense Ministry said on Wednesday it would halt operations on Thursday morning but made no mention of an army pullback from cities and said it would confront "any assault" by armed groups. Attacks on opposition neighborhoods over the last week have fuelled doubts it would comply with the truce.
The U.S. ambassador to the United Nations, Susan Rice, said the commitment could not be construed as complying with the former U.N. secretary-general's peace plan: "The burden remains squarely on the Syrian regime and not the opposition in the first instance to meet its obligations in full and visibly under the Annan plan," Rice told reporters late on Wednesday.
"The caveats in the letter are worrying and yet again cast into doubt the credibility of any such commitments. But nothing casts more doubt on the credibility of the commitments than the fact that commitments have been made and made and made and broken and broken and broken," she said, noting that attacks had intensified since Assad agreed to the plan two weeks ago.
Syria's U.N. ambassador, Bashar Jaafari, said his government was "on board" with the plan. But, he said on U.S. television, government forces would remain on alert to "counterattack" and that "legally speaking, there is a big difference between declaring a ceasefire and putting an end to the violence".
The opposition was also sceptical of Assad's intentions.
"The Defense Ministry announcement is a detour on Annan's plan, which clearly says he should pull back the tanks and end violence. We will wait until tomorrow and see. We will not act before tomorrow," Qassem Saad al-Deen, Free Syrian Army spokesman inside Syria, told Reuters on Wednesday.
A spokesman for Annan said an advance planning team that had been negotiating how U.N. observers would monitor the accord had left Damascus after a week. Its leader, Norwegian general Robert Mood, told Norway's NTB news agency he was "cautiously optimistic" but that there remained considerable difficulties.
"Both sides are plagued by a very high degree of mutual suspicion," Mood said. "It's terribly difficult for them to cross that abyss." A veteran of peacekeeping missions in the Middle East, Mood said he had mainly spoken to Syrian officials.
TURKEY CITES NATO
Turkey, hosting nearly 25,000 Syrian refugees, has been particularly alarmed, and Prime Minister Tayyip Erdogan raised the prospect of engaging its NATO allies to protect its borders after firing from Syria hit people in a refugee camp this week.
"NATO has responsibilities to do with Turkey's borders," he was quoted as saying by Hurriyet newspaper on Thursday, citing Article 5 of the North Atlantic defense pact, which allows for a common response to an attack on the territory of a member state.
Ankara has urged the Security Council to adopt a resolution that would protect the Syrian people, saying Damascus had not kept its troop withdrawal pledge and had increased the violence.
Annan, at a news conference in Tehran on Wednesday, urged Assad's long-time ally Iran to help resolve the violence and warned of "unimaginable consequences" if it worsened further.
Iranian President Mahmoud Ahmadinejad, quoted by state news agency IRNA, urged an end to violence but accused the NATO powers of expansionist ambitions in the Middle East and said Tehran's Syrian ally should not be put under pressure.
"NATO is not ashamed to say it wants to dominate the region and is trying to extend its domination eastward," IRNA said, quoting Ahmadinejad as insisting: "The implementation of any plan in Syria should be free of pressures and interference, and all violence in that country should be stopped."
Iran has unstintingly backed Syria, the only Arab nation to support Iran in its 1980-88 war with Iraq and the conduit for Iranian arms to Lebanon's Shi'ite Muslim Hezbollah movement.
Syria, where Assad's Shi'ite-rooted Alawite minority dominates a Sunni Muslim majority, has become an arena for a sectarian-tinged regional contest between Shi'ite Iran and Sunni Arab rivals aligned with the West and led by Saudi Arabia.
Assad's forces have killed more than 9,000 people in the past year, according to a U.N. estimate. Damascus says rebels have killed more than 2,600 soldiers and security personnel.

Trayvon Martin's mom says she believes Zimmerman shooting was an accident
Trayvon Martin's mom Sybrina Fulton said in an interview on the "Today" show Thursday that she believes it was "an accident" that George Zimmerman shot and killed her son in Sanford, Fla., on Feb. 26.
"I believe it was an accident," Fulton said. "I believe that it just got out of control, and he couldn't turn the clock back. I would ask him, did he know that that was a minor, that that was a teenager and that he did not have a weapon? I would ask him that I understand that his family is hurting, but think about our family that lost our teenage son. I mean, it's just very difficult to live with day in and day out. I'm sure his parents can pick up the phone and call him, but we can't pick up the phone and call Trayvon anymore."
Zimmerman, who is being charged with second-degree murder, is currently being held in protective custody at the Seminole County jail, awaiting a court appearance.
Earlier in the interview, Fulton said she is prepared to endure the trial, "even if that means that he may be found not guilty."
"We just want him to be held accountable for what he's done," Fulton said. "And by him not being arrested, that would not have been done. So we are happy that he was arrested so that the committee gives his side of the story."
Tracy Martin, Trayvon's father, said he believes police bungled the investigation, which led to the delay in Zimmerman's arrest.
"First and foremost, I think had the Sanford Police Department done a thorough investigation from the beginning, George Zimmerman would have been locked up from day one, and there wouldn't have been such a huge public outcry for the arrest," Tracy Martin said. "And if, in fact, we had to plead our case to public officials just to get him arrested, if that's what we have to continue to do to plead our case, then that's what we'll do."

Updating your Facebook status from your work computer ? even if it violates your company's policy ? isn't a federal crime, according to a ruling by a San Francisco federal appeals court.?
Sure it sounds extreme that such a question was even pondered by a federal court. ?But Facebooking and similar computer-based goldbricking could've been considered a violation of the the Computer Fraud and Abuse Act (CFAA) if the San Francisco's Ninth Circuit didn't dismiss "charges that would have criminalized any employee's use of a company's computers in violation of corporate policy," notes the Electronic Frontier Foundation:
In (U.S. v. Nosal), the government prosecuted an ex-employee of an executive recruiting firm on the theory that he induced current company employees to use their legitimate credentials to access a proprietary database and provide him with information in violation of corporate computer-use policy. The government claimed that the violation of policy constituted a violation of the CFAA, a law with criminal penalties.
While the case isn't specifically focused on Facebook, the ruling is another example of how the government is increasingly sucked into the conflict between how we earn a living and how we use the world's largest social network.?Earlier this week, Maryland became the first state to pass a bill prohibiting employers from demanding employee user names and passwords to Facebook and other social networks. In March, two U.S. senators asked federal agencies to look into whether employers and colleges that are asking for access to individual Facebook profiles are breaking the law.??
In?U.S. v. Nosal, accessing Facebook through work computers ? if against company policy ? could've been deemed a federal crime as well.?
In its role as a digital rights advocate, EFF filed an amicus brief ? an opinion volunteered by a party not involved in a legal case. In it, EFF argued that "turning mere violations of company policies into computer crimes could potentially create a massive expansion of the law ? making millions of law-abiding workers criminals for innocent activities like sending a personal email or checking sports scores from a work computer, and leaving them vulnerable to prosecution at the government's whim."?
In its full opinion, the court agreed:?
Many employers have adopted policies prohibiting the use of work computers for nonbusiness purposes. Does an employee who violates such a policy commit a federal crime? How about someone who violates the terms of service of a social networking website? This depends on how broadly we read the Computer Fraud and Abuse Act.
The court's findings overturn last year's ruling by a previous court which found that employees who violate their employer's computer policy could be accused of breaking the CFAA. The new opinion points out that broad interpretation of the CFAA could criminialize typical human behavior:?
Minds have wandered since the beginning of time and the computer gives employees new ways to procrastinate, by gchatting with friends, playing games, shopping or watching sports highlights. Such activities are routinely prohibited by many computer-use policies, although employees are seldom disciplined for occasional use of work computers for personal purposes. Nevertheless, under the broad interpretation of the CFAA, such minor dalliances would become federal crimes. While it?s unlikely that you?ll be prosecuted for watching Reason.TV on your work computer, you could be. Employers wanting to rid themselves of troublesome employees without following proper procedures could threaten to report them to the FBI unless they quit. Ubiquitous, seldom-prosecuted crimes invite arbitrary and discriminatory enforcement.
"EFF has been fighting these aggressive government hacking arguments for years," EFF Staff Attorney Hanni Fakhoury said in a statement. "We're happy to see the court recognize that the government overreached here, and it issued a thoughtful decision that protects the rights of users."

Yo-yo scam exploits credit-challenged car buyers

Imagine this: You buy?a car, sign all the paperwork and drive home. A few days?or weeks later, you?re contacted by the dealer and told the financing has fallen through and you need to bring back the car or pay more money.?
Leslie Hurst of Ludlow, Ky., doesn?t have to imagine what it?s like to be the victim of a ?yo-yo? finance scam. Three weeks after she bought her car, the salesman called and said she couldn?t afford it and needed to bring it back.?
?I couldn?t understand how this could happen,? she says. ?I had signed a contract and finance agreement with them. I had a payment plan set up. As far as I was concerned I had bought the car.??
Not knowing what else to do, she returned the car, which left her without transportation.?
For Carolyn Edwards of Wellington, Fla., the yo-yo financing nightmare started three weeks after she bought her Range Rover. The dealer called and said she couldn?t afford it. Edwards wouldn?t return the vehicle, so the dealer had it repossessed.?
?It was horrible. It was very humiliating,? she remembers. ?They took the vehicle away with all my stuff inside.??
?The dealers were lying,? says attorney Raymond Ingalsbe, who represents Edwards and Hurst. ?Once a buyer signs an installment credit contract, financing is extended by the dealer.???
If the dealer can?t sell the contract for the price they expected, Ingalsbe explains, they tell the buyer the financing fell through and demand a bigger down payment, a higher interest rate or both. In some cases, they want to cancel the deal and demand the vehicle back.?
The yo-yo scam is really bait-and-switch on the financing. According to new research from the Center for Responsible Lending (CRL):?
- The victims are usually buyers with poor credit or no credit and few financing options.
- More than half the victims of a yo-yo scam had trouble reclaiming their down payment or trade-in vehicle.
- A majority signed a new contract ? with a higher interest rate ? for the same car.
?This is much more than a once-in-a-while problem,? notes CRL?s Chris Kukla, senior counsel for government affairs. ??This is a pretty pervasive thing.??
For its report, Deal or No Deal: How Yo-Yo Scams Rig the Game against Car Buyers, the Center for Responsible lending surveyed five organizations that help people with auto finance problems. It found that 27 percent (that?s 590 out of 2,100 people) of their clients in the last twelve months experienced a yo-yo scam.?
The National Automobile Dealers Association says the practices laid out in the CRL report should not be present in the marketplace. In a statement to msnbc.com, David Hyatt, NADA?s vice president and chief communications officer, wrote: ?It?s important to note that the CRL report describes 590 complaints of alleged yo-yo financing that is fraudulent and already illegal in all 50 states. In those cases, it?s a matter of enforcement.??

Today?s sales are conditional
Dealers say most auto sales today are conditioned upon financing ? you get the car on the spot, even though the loan approval isn?t final. In other words, when you finance through the dealer, in most cases the dealership reserves the right to unwind the deal if it doesn?t make enough money selling your loan on the open market.?
NADA says the conditional nature of the transaction is explained to customers. Language to that effect is in the paperwork they sign.?
Tom Domonoske, an attorney with?15 years experience handling auto financing cases, says many people don?t understand that the dealer can revoke the sale after they sign the sales contract.
At the same time, the finance manager is looking the consumer in the eye and saying, ?Congratulations, you?ve bought the car,? they?re slipping in this document that says we haven?t agreed to sell you anything yet.??
It?s not easy to protect yourself. Only about a third of the states have any sort of restriction on conditional auto sales. Everywhere else, there?s only one guaranteed way to eliminate the risk of getting burned by a conditional sale being revoked: Skip the dealer financing and get your auto loan from a bank or credit union or some other lender.
?This would prevent a yo-yo transaction and let you negotiate the best deal,? says John Van Alst with the National Consumer Law Center.?
Unfortunately, as Van Alst points out, this is not an option for many people with bad credit.?
If you finance through the dealer you need to read the contract and look for any language that says the sale is conditional.?
Can something be done about this?
The car dealers don?t see any problem. Consumer advocates want the federal government to end this practice. They want federal rules in place that require auto sales contracts to be binding on both parties.?
?We think the one-way deal is unfair,? says Chris Kukla with the Center for Responsible Lending. ?The dealer should not have the ability to back out of the deal ? days, weeks or even months later ? because they?ve decided that the profit is not to their liking. No other industry is allowed to do that. We think it?s inappropriate and it needs to stop."
Last year the Federal Trade Commission held a series of workshops on auto financing. Will this result in new regulations??
?We are considering what next steps, if any, we should take,? says Malini Mithal, assistant director of the FTC?s division of financial practices.?
These next steps could include consumer education, enforcement actions or new rules.?
My two cents
Right now, unless you?re a lawyer or have one read the sales contract for you, you can never be 100 percent sure that your sale is final when you finance through the dealer. That?s crazy. That?s why I hope the FTC will propose some new rules that protect buyers.?
The industry says there are millions of these conditional transactions each year and most take place without a hitch. OK, but why should anyone be left in the lurch like this??
Car buyers today want to drive home with their new vehicle. Dealers want you to do that so you can?t shop someplace else.?
We live in a computer age. These transactions can take place at Internet speed. If the dealer can get his price for my loan, then sign the paperwork and be bound to it. If not, tell me you can?t sell me the car today.?

Iran to offer new proposals at nuclear talks
DUBAI (Reuters) - Iran will present new proposals at talks on Saturday aimed at easing concerns about its nuclear activity, state television said, but it was unclear if Tehran was willing to address its disputed uranium enrichment drive as six world powers want.
The report did not specify what Iran was set to offer and one western diplomat said he doubted it would be enough for any quick lifting of sanctions on the Islamic Republic which the West suspects may be seeking nuclear weapons capability.
"Iran's representatives will participate in the negotiations with new initiatives and we hope that the (six powers) will also enter talks with constructive approaches," said the head of Iran's Supreme National Security Council, Saeed Jalili, according to Iran's English-language Press TV on Wednesday.
Jalili, Iran's chief nuclear negotiator, said Tehran was "ready to hold progressive and successful talks on cooperation" but that "the language of threat and pressure against the Iranian nation has never yielded results".
Previous rounds of talks with the P5+1 group - the five U.N. Security Council members, the United States, Britain, France, Russia and China, plus Germany - foundered in part because of Iran's refusal to negotiate on the scope of its uranium enrichment work, instead floating vague proposals for trade and security cooperation.
Tehran says it is refining uranium solely for electricity and medical treatments. Western states do not believe this and the United States and Israel have not ruled out military action if diplomacy fails to curb Iran's nuclear work.
The western diplomat said he did not expect Tehran to offer anything big enough to merit the lifting of a European embargo on Iranian oil that is due to be fully implemented by July 1.
"It would be a surprise if Iran did something that merited moving on that," the diplomat said. "It would need a significant change, I think, from Iran before that kind of alteration to the sanctions regime becomes credible."
OUT OF THE CUPBOARD
On Sunday, the head of Iran's Atomic Energy Organisation, Fereydoun Abbasi-Davani, raised the possibility of Iran suspending enrichment to the 20 percent level of fissile purity if its needs were met.
The proposal did not address Western concerns about what would ultimately happen to Iran's existing reserve of such higher-grade enrichment uranium.
Uranium needs to be refined only to up to 5 percent for use in running power plants. A 90 percent threshold is required for atomic bomb material.
Iran says it needs a 20 percent stockpile to fuel a medical isotope reactor. Western powers fear Iran's underlying goal is to advance towards bomb-grade purity and are seeking guarantees via negotiations that this will not come to pass.
The western diplomat said a previous deal with Iran that would have seen it export some of its enriched uranium in exchange for fuel for the medical reactor still made sense in theory, but would have to be altered to reflect Iran's increasing stockpile of nuclear material.
"On the fuel swap side it isn't really credible to think of just sort of getting out of the cupboard the previous offer. That said, the logic of Iran exporting some, all of, (its) uranium enriched to various levels as one of its confidence building steps, obviously, is a key thing still," he said.
INSULT
If progress is made, the talks could pave the way to ease sanctions and might lift the threat of an Israeli attack.
President Mahmoud Ahmadinejad said Iran would not be bullied at the talks.
"They constantly insult the Iranian nation and use a language of force against Iranians," state news agency IRNA quoted him as saying at a rally.
"Speaking on behalf of the Iranian nation, I tell them that this method will not work ... and that they should speak with respect."
Iran state says it has a sovereign right to uranium enrichment and accuses the nuclear-armed West of hypocrisy and of trying to stifle its technological progress.
Separately, Iran said on Wednesday it had banned imports from 100 European companies to counter Western sanctions.
Sassan Khodaei, deputy head of the state-run Trade Promotion Organisation, said the move was part of a policy to counter "antagonistic measures" by the EU, Press TV reported.
Khodaei said the banned goods included luxury items which Iran can produce itself, but he did not name goods or their manufacturers.
A report from Press TV on Tuesday said Iran had stopped oil exports to Spain as a pre-emptive measure before the EU embargo comes into force on July 1, but Spain's biggest refiner said it had stopped buying from Iran months earlier.
